Weston County expressly states that its only local land-use regulations are subdivision regulations and directs construction permitting to the State Department of Fire Prevention; incorporated municipalities may have separate local requirements. State Fire Marshal plan review is limited to listed project classes: government-owned or leased buildings, schools, public-access buildings over 5,000 square feet, child-care centers for more than ten children, multistory buildings, assembly occupancies, qualifying alterations or changes of occupancy, fire-protection systems, alternative-energy installations, certain tanks and dispensing facilities, commercial kitchen hoods, spray finishing, and RV/camp/mobile-home park site plans. Ordinary private one- and two-family construction that does not meet a listed trigger is outside that state fire/life-safety plan-review list, but state electrical, DEQ septic, State Engineer well, County subdivision and municipal requirements may still apply.
