Minor-work playbook

Understand what may be exempt—and what is not.

Single-story residential accessory structures smaller than 256 square feet do not require a Fauquier building/zoning permit, but they must meet zoning setbacks. Fences generally do not require a building permit unless used as a pool barrier, and retaining walls holding no more than 3 feet of earth are generally exempt when not supporting a surcharge. Virginia USBC exemptions also include ordinary minor repairs and cosmetic work; qualifying low-voltage work; tents under 900 square feet with fewer than 50 occupants; small pools; certain flagpoles and temporary residential ramps; same-location, same-capacity LP-gas container replacements; and qualifying farm structures. Zoning, land-disturbance, floodplain, health, or other approvals may still apply.

A permit exemption generally addresses one narrow construction trigger. It does not automatically waive zoning, land-use, floodplain, shoreline, fire, energy, electrical, utility, septic, or right-of-way requirements. Footings, reinforcement, framing, fireblocking, wiring, piping, insulation, weather protection, and life-safety systems each have points where the work must remain accessible.
