Codes, exemptions & field inspections

Build to the adopted code. Verify every exception.

This guide translates the available agency record into a preconstruction checklist for structural scope, minor work, and inspection release. The adopted code and the issuing official control when a field condition is disputed.

Regulatory framework

The code baseline for Botetourt County.

As of January 18, 2025, Botetourt County requires all permits to comply with the 2021 Virginia Uniform Statewide Building Code cycle, including the 2021 Virginia Construction, Residential, Existing Building, Plumbing, Mechanical, Fuel Gas, Energy Conservation, and Swimming Pool and Spa codes with Virginia amendments and the referenced 2020 National Electrical Code. Applicable 2021 Virginia Statewide Fire Prevention Code, Industrialized Building Safety Regulations, Amusement Device Regulations, and local design criteria also apply. Beginning September 16, 2025, new commercial and residential buildings require COMcheck or REScheck unless the prescriptive energy-code path is used.

Inspection lane

Request inspections or onsite consultations by emailing Development Services or calling 540-928-2070; provide the permit number, property owner's name, site address, and inspection type. Requests received before 4:00 p.m. are scheduled for the following day; requests after 4:00 p.m. Friday are scheduled for Tuesday. Applicants may request AM or PM, honored as staffing and workload permit. Post the building permit visibly from the road and keep a complete approved plan set onsite. Work must be ready and previous corrections complete to avoid $25 first-reinspection fees and higher repeat charges.

Minor-work playbook

Understand what may be exempt—and what is not.

Virginia USBC exemptions include qualifying one-story detached storage sheds, playhouses, and similar accessory structures not exceeding 256 square feet; fences other than required pedestrian-safety or swimming-pool barriers; qualifying tents not exceeding 900 square feet with 50 or fewer occupants; certain low-voltage wiring; limited roof-decking replacement on specified residential occupancies; and ordinary repairs such as painting, wall covering, cabinetry, and floor covering. Bona fide farm buildings used in farming operations may qualify for the County's farm-building affidavit process. Zoning approval, floodplain, land-disturbance, utility, and other requirements can still apply even when a building permit is exempt.

Field rule

A permit exemption generally addresses one narrow construction trigger. It does not automatically waive zoning, land-use, floodplain, shoreline, fire, energy, electrical, utility, septic, or right-of-way requirements. Obtain written confirmation when the project involves a new structure, structural alteration, change in occupancy, or concealed work.

Inspection pipeline

Keep the work visible at every release point.

Retain the approved plans, inspection approvals, correction responses, and final certificate or occupancy release with the property file.

Contractor verification

Verify the builder before the contract is signed.

Use the state licensing system to verify active registration, trade credentials, bond status, and liability coverage where available. Match the legal business name to the proposal and permit application.

Planning reference

Keep the parcel rules beside the building plans.

A building permit is only one part of statutory compliance. Check the local zoning, ordinance, map, or land-use reference before finalizing setbacks, height, lot coverage, access, drainage, or accessory structure placement.

Field sequencing matters

The inspector needs to see the work at the right moment.

Code compliance is not only a plan-review exercise. Footings, reinforcement, framing, fireblocking, wiring, piping, insulation, weather protection, and life-safety systems each have points where the work must remain accessible. Build the inspection calendar into the trade schedule instead of treating it as a final administrative step.

When a project qualifies for a narrow minor-work exemption, keep a written explanation of why it qualifies and confirm that related zoning, utility, fire, energy, or environmental rules do not create a separate approval requirement.

Closeout file

Keep the approved plan set, inspection approvals, correction responses, contractor license verification, final certificate, and any occupancy release together. A clean record protects the owner, builder, lender, insurer, and future buyer.
