Minor-work playbook

Understand what may be exempt—and what is not.

Qualifying one-story detached sheds, playhouses, and similar accessory structures of 256 square feet or less are exempt from a building permit, although zoning requirements still apply. Virginia USBC exemptions also cover tents no larger than 900 square feet with an occupant load of 50 or less; fences other than pool or pedestrian-safety barriers; ordinary minor repairs and cosmetic work; qualifying low-voltage work; pools no larger than 150 square feet, 5,000 gallons, and less than 24 inches deep; small retaining walls; certain flagpoles and temporary residential ramps; and same-location, same-capacity LP-gas container replacements by the supplier. Qualifying farm structures may use the county's farm-structure affidavit, but zoning, floodplain, health, or other approvals may still be required.

Field rule

A permit exemption generally addresses one narrow construction trigger. It does not automatically waive zoning, land-use, floodplain, shoreline, fire, energy, electrical, utility, septic, or right-of-way requirements. Code compliance is not only a plan-review exercise. Footings, reinforcement, framing, fireblocking, wiring, piping, insulation, weather protection, and life-safety systems each have points where the work must remain accessible.
